Can I Claim for an Accident That Was Due to Work Equipment?
If you weren’t given the correct equipment or the equipment you were given was faulty or defective, and as a result you had an accident at work, there’s a good chance you could make a claim.
Where did the accident happen?
If the accident took place when there were people around, or CCTV cameras caught footage of the accident, your claim stands a better chance of success. Even without witnesses or CCTV we may still be able to pursue a successful claim for you.
When did the accident happen?
In most claims for personal injury Court proceedings must be issued within three years of the date of the accident otherwise the Court will refuse to consider the claim. We strongly recommend you pursue a claim as soon as possible as the longer you wait, the more difficult it may be to prove your claim. Usually, we will not take on your claim if the accident happened more than two years ago.
Can you prove that the accident happened?
In order for us to help you make a claim, you’ll need to be able to prove that the accident happened. There are several ways in which you can prove that an accident happened:
• Witnesses – was there anyone there who can verify what happened?
• Accident book – did you report your accident or injury to your employer? Was it recorded in an accident book?
• Medical appointments – did you visit your GP, or go to the hospital after your injury?
