How does a Trust work?

A Trust is a method for managing the money, investments, land and/or buildings of a person. Involving a settlor (who places the assets into the Trust), a trustee (the person who manages it), and beneficiaries (people who benefit from it), the Trust will specifically manage these assets based on the wishes stated in a trust deed or a relevant Will.

Why might a Trust be considered?

You may wish to set up a Trust for a child or children for the future. It may be they are not old enough to receive the assets at the time of the Trust’s creation, or they may not be responsible enough to use them wisely. The beneficiary may be incapacitated. What is the difference between a Will and a Trust?

A Will is a legal document that comes into effect from the point when a person dies. It involves the specific wishes of that person in relation to their assets and a range of other related matters. Whereas this can’t be implemented while the person is still alive, a Trust, on the other hand, can be set up during the person’s lifetime and can take effect immediately.

A major difference between the two is that a Will directly concerns the distribution of assets after death, while a Trust focuses on the control of assets and money.

A Will can also create a Trust but that does not come into fruition until you have died.
