FAQs About School Accident Claims and Compensation

A regular list of frequently asked questions will undoubtedly crop up when considering school accident compensation claims.

As an accident management specialist, we’re here to help.

This article intends to answer some of those questions based on our decades of experience in the field of making claims.

What is school accident compensation?

School accident compensation relates to a personal injury compensation claim following an accident at school, or on a school-arranged trip, that caused injury to the affected person. This monetary figure is based on the severity of the injury and the treatment requirements, and ongoing adjustments needed to accommodate a life altered by injury.

Winns were professional and thorough, they ensured I received the best treatment for my injuries and I can’t recommend the physio they provided enough! Amazing service and the compensation paid out for my injury was appropriate and fair.

What types of accidents at school are common?

It’s never something you wish to consider, but accidents do happen to those using school sites:

  • An injury caused while taking part in P.E. lessons, or other specialist lessons like Design Technology and Cookery where the risk of injury is much greater
  • A fall down a set of stairs or on uneven surfaces
  • A fall from playing equipment in the yard
  • A slip while moving on untreated surfaces.

These are just some of the many examples of accidents at schools.

How do you make a claim?

The process usually involves engaging with an accident management specialist, a company that can help guide you on the correct legal pathway, avoiding mistakes that can result in a negative outcome.

They will initially seek to gather as much evidence as possible to confirm your version of events and do this effectively and efficiently so witness statements are fresh in the memory and a clear vision of what happened can be supported by evidence.

Then comes the negotiation phase with the at-fault party, which will be conducted by your legal representatives.

If an agreement is reached, the personal injury compensation will be transferred over, after the client has agreed to the amount. If no resolution can be reached, there may be a need for a court hearing; however, it should be noted that this is only needed for a minimal number of claims.

How much can I claim for?

The amount of compensation you could be eligible for is dependent on the nature of the accident and the severity of the injuries sustained. A lot of the factors that can affect compensation amounts are affected by your unique circumstances.

Do I claim directly against the school?

Although this is true to an extent, the school will not pay the financial settlement from their own budget. Instead, they should have relevant public liability insurance cover to cater for such events. The insurance provider will be liable to make the payment, meaning the school won’t suffer financially because of your claim.
