What is a personal injury claim?

Personal injury relates to injury or illness caused as a result of third-party negligence in an accident. This is the major factor when making a personal injury claim. If this is proven and accepted by the third party, then you may be able to make a claim. Contact our team today to discuss your circumstances.

What are the time limits for making a personal injury claim?

When making a personal injury claim, you have three years from the date of the accident to begin the application as dictated by law.

There are exceptions to this; if you are under the age of 18 at the time of the accident, your statutory time-limit starts from your 18th birthday, as opposed to the date of the accident.

Other exceptional circumstances include clients who lack mental capacity, or if you are dealing with the claim on behalf of a deceased love one. The three-year time period for the latter starts from the day you discovered the cause of their death.

What is the personal injury claims process?

The process involves making a claim for compensation based on injury and/or financial hardship caused by an accident that wasn’t your fault:

  • It begins with the first call to Winns and an immediate assessment of your circumstances in relation to the accident. Your file handler will provide the support you need instantly, whether that is to do with your vehicle or treatment for your injuries.
  • Once initial details are taken, Winns will gather the relevant evidence to ensure a strong case so as to improve your chances of liability being accepted by the at-fault party.
  • Your injuries will be assessed by an independent medical professional, who will produce a medico-legal report.
  • If your vehicle was damaged in the accident, we will arrange for it to be collected and taken to be repaired. A like-for-like replacement hire vehicle will be available to you while yours is being repaired.
  • Negotiations will take place between Winns and the third-party insurer.
  • Upon your instructions, a settlement will be agreed and the formalities will be completed.
  • You receive the settlement amount.

How much compensation can you claim?

The amount of compensation for your personal injury claim depends on the nature and severity of your accident, the injury sustained and the lasting implications on your future way of life.

To get an informed estimate as to what you may get in compensation following a non-fault accident, call the team at Winns to discuss the specifics of your claim, the nature of your injury/injuries and the events leading up to the accident.

How long does a personal injury claim take?

A standard claim can take from six to 18 months, depending on the nature and complexity of the claim. If it is a particularly complex case, involving many different facets, this may take longer. Serious injury claims can take much longer as our team works to implement suitable care and, potentially, life-long support.

How can I pay for my personal injury claim?

If you choose Winns to handle your claim, there are no upfront costs to pay and you will enter a ‘no win no fee’ agreement. Winns will handle all aspects of the claim, using legal experts and extensive experience in personal injury claims to help you reach a satisfactory conclusion.

You won’t be charged directly for using our services, instead we take a deduction of 25% from your personal injury compensation and any diminution (loss in value of your vehicle) awarded.

An insurance policy will be offered to you to cover any legal expenses should the end result of the claim go against you.

My advisor was very helpful. After such a stressful event happening, he talked me through everything and explained the next steps for me. I couldn’t ask for a better experience in my eyes. Thank you so much!

Jena Budd

Jack Ames

I have been very happy with the level of service provided by Winn Solicitors and the gentleman who is dealing with my case thus far. A colleague recommended Winns to me stating their care and professionalism as being very high and so far I can only agree. My case handler has been extremely helpful and patient with me, especially in tracking down all of the relevant information needed for my claim, which hasn't exactly been easily accessible. Would definitely recommend!

Why make a personal injury claim with Winns?

Our team has extensive experience across a wide range of claim types and circumstances. They have helped thousands of clients each year to access compensation for a number of financial aspects associated with a non-fault accident, including:

  • Personal injury compensation
  • Recovery of hire costs if a replacement vehicle is required
  • Loss of earnings
  • Any other out of pocket expenses which can be shown to be caused as a result of the accident

Utilising a dedicated team, including experienced personal injury solicitors, Winns co-ordinates your claim from start to finish. No need to liaise with multiple parties, no need to stress about deadlines and time limits, and no need to worry about feeling unsure about how the process works. Winns takes care of it all.

We will make an initial assessment of your claim on your first call before arranging a replacement vehicle, if yours is damaged, within four working hours of instruction.

Your file handler will then co-ordinate collection, safe storage, assessment and repair of your damaged vehicle, all while concurrently progressing a personal injury claim.

If you require treatment following the accident, Winns will arrange this, with a medico-legal report produced, to support a personal injury claim, by an independent medical professional.

All you need to do is focus on getting back to your normal, and back on track.
