An LPA is a document that legally gives responsibility to a chosen person, or people depending on your wishes, who can make decisions on your health and welfare – including daily routine, medical care, moving into a care home, and/or life-sustaining treatment - or financial affairs – managing bank accounts, paying bills, collecting benefits or a pension, and/or selling property - based on the LPA being created. There are two types of LPA and you can choose to make one or have both.

Absolutely. You can have more than one person act as an attorney in your affairs. As part of this discussion, you can state if they can make decisions on their own or if they need universal agreement among the attorneys involved. If it is the latter, it’s important to note that the LPA would fail if one of the attorneys died or lost the capacity to manage your affairs. To mitigate this, you can nominate replacements should this scenario arise.
Our team will arrange an initial meeting to discuss your circumstances and wishes. They will then set about putting this into a draft document which, once complete, will be sent to you for looking over and approval. Once finalised, the document will need to be signed in the presence of a witness, as stipulated by law. The completed LPA will then be registered with the Office of the Public Guardian.
A living Will allows you to express your wishes regarding refusing medical treatment if your future is affected by such a scenario whereby you were unable to make or communicate your own decisions. It’s a legally binding document meaning your wishes are carried out.
This can lead to confusion among loved ones as to what you would specifically want in terms of treatment or in relation to the handling of your financial affairs. They may not agree with what you had previously thought or may simply not know what your wishes are if you hadn’t openly discussed them which is possibly as it can be a sensitive talking point even among loved ones.
