Who can make a claim?

If you have been injured as a result of an accident that wasn’t your fault on the road, in a public space or at work then you can make a claim, as long as the incident took place within the last three years.

Alternatively, if you were under the age of 18 at the time of the accident, your statutory three-year limit on making a claim begins from the day you turn 18.

Who do I make the claim against?

When beginning the process, you are making a claim against the third party, be it the driver who caused the accident (on the road) or the company/organisation in charge of the environment where an accident took place. Although liability is assigned to them, the compensation itself should be covered by their insurance provider, who will provide suitable cover for their client to accommodate these types of incidents.

If on the road, it will be car insurance cover, which is a legal requirement for every driver, and if it is in a public/commercial space then the organisation should have suitable public liability or employer’s liability insurance.

What does the compensation help pay for?

What happens if a broken bone heals incorrectly?

If a broken bone does not heal properly, this is known as a non-union and can have lasting implications.
