If you’re considering making a claim, talk to Winns now.
When you contact our team, they will guide you through the process throughout, initially asking you questions which will help establish your eligibility to make a claim. They will then progress your case, taking the effort and stress away so you can focus on recovery from your neck injury.
As we are a one-stop-shop for accident management, we can offer swift access to suitable treatment, making all the necessary arrangements to get you back on the road to recovery, with no upfront costs to pay.
While all this takes place, we will be seeking suitable compensation from the third-party insurer if they have accepted liability. If they choose not to, we will take necessary action on your behalf and seek court assistance to get compensation for you.
If you would like to make a neck injury claim following a non-fault accident, all you need to do is pick up the phone and call 0800 988 6288 (available 24 hours a day) to speak to one of our advisors.
Alternatively, you can request a call back through our website. Another option on the Winn Solicitors website is Live Chat, where you can instant message one of our expert team (available 7am - 7pm every day).
If you are considering making a claim, there are a few factors to consider. The accident that caused your neck injury must have occurred within the last three years, and the accident itself should be the fault of a third party. If this is the case, contact Winns’ dedicated team of injury specialists at any time, 24 hours a day, seven days a week through the claim-line.
When instructing Winns to make a claim on your behalf, we will seek to recover costs and compensation from the third-party’s insurance provider.
The claim is not made against the person who was directly liable for the accident, but rather their insurance provider, as they should be insured regardless of whether your neck injury was sustained on the road, in a public place or work environment.
The type of insurance cover may vary, but it is the insurance provider who will be liable to pay costs and compensation agreed.
Neck injuries can occur in a number of scenarios where an accident has taken place. One of the more common environments is on the road. Road traffic accidents happen frequently on UK roads, leading to injuries sustained by drivers and passengers alike, including whiplash, which is caused as a result of the intensity of the impact violently moving the body.
There are many work scenarios which require staff to climb up to a height off the ground. This could be a window cleaner working up a ladder, a warehouse operative getting stock from a raised area or a builder working on an unfinished structure on a construction site.
The issue arises if they should fall, causing damage to the body. Depending on how they fall, this can lead to a neck injury, the severity of which depends on the type of fall and the conditions of the accident.
Whether at work or out in a public place, there is always the danger of slipping on something that has been left on the floor, or perhaps cleaning has taken place without any signs to indicate that a surface may be slippery. This could lead to a slip and subsequent injuries, including neck damage. Tripping at work or in public is also a common way to sustain a neck injury.
Being asked to lift objects that are too heavy for an individual to carry, or without being provided with the correct equipment to do so can lead to a neck injury. It is the responsibility of the employer to ensure the potential for a neck injury is limited when lifting objects. If you lift and suffer a neck injury as a result, the company you work for may be liable.
There are varying degrees of injury which can affect people when the neck is involved, ranging from whiplash and soft tissue damage through to a broken neck and/or paralysis. With the spinal column being part of this area of the body, damage to the neck region can affect other parts of the body, potentially causing paralysis as a result.
If you suffer a serious injury like this, we have a dedicated serious injury team who specialise in helping clients plan for an alternative future. This includes getting compensation, arranging home modifications and providing interim payments should your claim be long-term. An injury like this is not just about the present but the future as well, and our serious injury team can facilitate on-going treatment should it be required.

After being in a road traffic accident and not being at fault, my car [is] smashed, my neck and lower back are sore. I was told by close friends to call Winn Solicitors. The next day I called Winns and spoke to Jake who, from the start of our conversation put me at ease, explained how my claim will progress. After about half an hour, I was pleased I was informed to call Winns.

The size of settlement for a neck injury depends on a number of factors, including the nature of the injury, the amount of rehabilitation required and the impact it has on a person’s ability to function, as well as work.
A personal injury claim for an injury sustained in an accident which wasn’t your fault should be made within three years of the accident taking place. There are few exceptions, but if you were under 18 when the accident took place, then you have three years from the date that you turn 18 to make a claim for compensation.
When damage is suffered in the tendons, ligaments and soft tissue, this can cause whiplash, which can lead to restricted movement and pain in that particular area of the body. It can often take many months to heal fully, but the expectation is you would make a full recovery from these injuries, barring any complications.
Neck injuries which can be classed as moderate include a variety of ailments, including soft tissue damage which has resulted in a fairly protracted recovery and injuries such as fractures, which lead to the need for spinal fusion. This is far from a definitive list, however, your injury and required treatment will be assessed by independent medical specialists as part of your claim, to help determine the severity of the injury and any necessary treatments.
This category is associated with serious, life-changing injuries which can lead to loss of use in a limb and incomplete paraplegia. This is not a definitive list of injuries but highlights the severity of those injuries that may be included in this category.
It is important to note that the levels of compensation vary from claim to claim, as several factors are taken into account when negotiating a settlement amount.
If you have suffered a neck injury as a result of an accident on the road, at work or as a result of a slip or trip in a public place you could make a claim with Winns.
