Do you need a solicitor for the Probate process?
Although you don’t need a solicitor for the Probate process, the benefits of having one are many.
There is the option to do it yourself but would you be sure of the legal formalities involved? Would you know which forms are required? Could you ensure all elements are covered and all assets included in the estate and avoid mistakes and erroneous judgements that could be more costly further down the line?
All of these are important things to consider when deciding whether to conduct the process without legal assistance.
Benefits of using a legal professional in the Probate process
A legal professional is exactly that; someone with a specialist knowledge of the processes and procedures involved and someone who will have experience of handling matters related to the estate in question.
By using a Wills, Probate, and Trust team, you get reassurance that what is being done in relation to your estate is correct, relevant, and covers the required aspects, based on the unique circumstances surrounding it.
An estate can be made up of different sections, including monetary values, properties, shares, and liabilities, with variations in beneficiaries adding to the potential complexity.
Many individuals won’t know what to do, and when. After all, it’s rare Probate will come up in conversation during your lifetime until it is absolutely necessary.
Entrusting a legal professional will mean Probate is delivered and done correctly as demanded by the legally bound Probate process.
Rebecca came to my home making the whole experience easy and more manageable for me. Everything was explained clearly, and very helpful advice given at every stage. Altogether, what can be a difficult and stressful situation was made so less complicated by Rebecca’s calm and confident approach.

Common mistakes when doing a DIY Probate
There are many difficulties in the Probate process.
Discovering all relevant assets takes time and diligence, as does the need to ensure all beneficiaries are identified, informed, and communicated with.
Ensuring all documentation is completed and submitted to the appropriate departments is essential.
Knowing about inheritance tax and how it could/does apply to the estate being administered is also important.
If you were to falter on any of those subjects, it can lead to complications needing legal assistance to fix.
All of a sudden, the costs saved at the start when deciding to do it yourself will be redundant as it may take time, and expertise, to sort out the problems created.
Initially, navigating the probate process felt overwhelming, but thanks to the invaluable assistance of Rebecca and Alex, it became remarkably straightforward. Their dedication and support exceeded expectations. I can't praise them enough for their exceptional service throughout this journey.
