How Do I Claim for a Non-Fault Car Accident?

What exactly is a non-fault car accident?

Essentially, a non-fault accident is when another party is at fault. In order to make a compensation claim, it must be possible to prove that the other party is at fault for the accident. Generally, this would be another driver, but it is also possible to claim in situations where a pedestrian or even an animal caused the accident.

Can I claim?

If you’ve had a car accident in the last three years, and the accident wasn’t your fault, you could claim for compensation.

What can I claim compensation for?

If you’ve incurred damages or losses as a result of a non-fault accident, don’t worry - you can claim for them. This could include: damage to your vehicle, replacement car costs, injuries and physiotherapy or other rehabilitative treatments.

What evidence will help my claim?

If you are in a non-fault road traffic accident, note the make, model, colour and registration of the vehicle. Exchange names, addresses and insurance details. Take down details of witnesses, locations, damages and accident circumstances. If you can, take photos or draw a sketch of the scene. All of this information will be useful in establishing the at-fault party. Keeping any voicemails, text messages, emails and hand-written documents relating to the accident can also be of benefit.

How much compensation will I receive?

Compensation varies depending on the specific circumstances of the accident, and the severity of any injuries sustained.
